End User License Agreement

Effective and last updated September 30, 2026

This End User License Agreement (this "license") is between you and MK Development, a sole proprietorship (eenmanszaak) owned by Max Kruiswegt, based in Zandvoort, the Netherlands ("we" or "us"). It gives you the right to use the Kaizen app. Our full contact details are under Contact. By installing or using Kaizen, you accept this license.

What this license covers

Kaizen is a focus app: a Pomodoro timer and stopwatch, tasks, habits, focus statistics, Focus Rooms for studying alongside other people, music and timer backgrounds, reminders, and, on iPhone and Android, app blocking.

This license covers the Kaizen app wherever you get it: from Apple's App Store (iPhone and iPad), Google Play (Android), or the Microsoft Store (Windows), and the web app at my-kaizen.app, including when you install the web app on your device. In this license, "Kaizen" or "the app" means all of these, "the stores" means the App Store, Google Play, and the Microsoft Store, and "iPhone" includes iPad.

This license is only about your right to use the app. Everything else, such as your account, Premium, and the rules for using Kaizen, is in our Terms. See Everything else is in our Terms.

Your license

We give you a personal, non-exclusive, non-transferable license to install and use Kaizen on devices you own or control, and to use the web app in your browser, for your own use. That includes using it for work or study. The rules of the store you got Kaizen from also apply, including family sharing where that store supports it. We keep all rights that this license does not expressly give you.

What you may not do

You may not:

  • sell, rent, lend, share, or otherwise pass on the app to anyone else, except as a store's rules allow
  • copy or change the app, except to install and use it as this license allows, or as the law allows
  • reverse engineer, decompile, or disassemble the app, or try to get its source code, except where the law allows you to
  • remove or change any copyright, trademark, or other notice in the app
  • get around technical limits in the app, such as the features that need Premium
  • use the app in a way that breaks the law or our Terms

Backgrounds and music

The backgrounds and music that come with Kaizen are ours or licensed to us by their creators. You may use them only inside Kaizen. You may not copy them out of the app, share them, or use them anywhere else.

Open-source software

Kaizen includes open-source software under its own licenses. Nothing in this license limits the rights those licenses give you.

Updates and system requirements

This license also covers updates, whether they come through a store or, on iPhone and Android, as small updates the app downloads itself. The web app updates when you reload it.

Each store listing shows which devices and system versions Kaizen supports. The web app needs a current version of a major browser. You need an internet connection to sign in, sync your data, join Focus Rooms, and buy Premium. Over time, we may stop supporting older devices or system versions.

Ownership

Kaizen is licensed to you, not sold. We own the app, including its code and design, and the Kaizen name and logo, or we use them under license from their owners.

Your rights under consumer law

If you use Kaizen as a consumer, the law where you live gives you rights that this license cannot take away. For example, Kaizen must work as described, you get the updates needed to keep it working and secure, and if it doesn't work as it should, you may be entitled to a fix, a price reduction, or a refund. Nothing in this license limits those rights.

We work to keep Kaizen reliable, but we can't promise that it will always be available or free of bugs. Timers and reminders depend on your device's settings and operating system. Kaizen is a focus tool, not medical, psychological, or other professional advice, and we can't promise any particular result.

App blocking works only on iPhone and Android and uses your phone's own tools: Apple's Screen Time on iPhone, and usage access and display over other apps on Android. You control those settings, and on Android some apps, such as the phone dialer and Settings, can never be blocked. App blocking is there to help you focus. It is not a security or parental-control tool, so don't rely on it where your safety or someone else's is involved. Your block list stays on your device (and in your phone's own backups, if you use them).

If something doesn't work as it should, email [email protected].

The stores' rules

If you got Kaizen from a store, that store's rules for apps also apply: Apple's Media Services Terms and Conditions for the App Store, the Google Play Terms of Service, or the Microsoft Services Agreement and Microsoft Store Terms of Sale for the Microsoft Store. If a store's rules give you more rights than this license, you keep those rights. If this license conflicts with a store's rules, the store's rules win.

If you got Kaizen from the App Store

These terms also apply if you got Kaizen from Apple's App Store:

  • This license is between you and us. This license is an agreement between you and MK Development only, not Apple. We, not Apple, are solely responsible for Kaizen and its content.
  • Where you can use it. You may use Kaizen on any Apple-branded device you own or control, as the Usage Rules in Apple's Media Services Terms and Conditions allow. Other accounts linked to the purchaser through Family Sharing or Apple's volume purchasing can use it as those rules allow.
  • Maintenance and support. We, not Apple, are solely responsible for maintaining and supporting Kaizen. Apple has no obligation at all to provide maintenance or support for it.
  • Warranty. We, not Apple, are responsible for any warranty that applies to Kaizen, whether we give it or the law implies it, to the extent it is not effectively excluded. If Kaizen fails to meet such a warranty, you can tell Apple, and Apple will refund the price you paid for the app, if any. To the extent the law allows, Apple has no other warranty obligation for Kaizen, and any other claims, losses, liabilities, damages, costs, or expenses caused by such a failure are our responsibility, not Apple's. This does not limit your rights under consumer law.
  • Product claims. We, not Apple, are responsible for handling any claims by you or anyone else relating to Kaizen or your possession and use of it, including product liability claims, any claim that Kaizen fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
  • Intellectual property claims. If anyone claims that Kaizen, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for investigating, defending, settling, and discharging that claim.
  • Legal compliance. You represent and warrant the statements under Export and sanctions, including that you are not in a country under a US Government embargo and are not on a US Government list of prohibited or restricted parties.
  • Our contact details. Questions, complaints, or claims about Kaizen go to us, not Apple. Our name, address, phone number, and email address are under Contact.
  • Third-party terms. When you use Kaizen, you must follow the terms of any third party whose service you use with it, such as your mobile carrier or wireless data provider.
  • Apple as third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of this license. Once you accept this license, Apple has the right (and is deemed to have accepted the right) to enforce it against you as a third-party beneficiary.

Support

For help with Kaizen, email [email protected]. We, not the stores, are responsible for supporting the app.

Export and sanctions

You represent and warrant (in other words, you confirm) that you are not located in a country that is subject to a US Government embargo or that the US Government has designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties. You may also not use Kaizen if European Union, United Kingdom, or United Nations sanctions forbid us from providing it to you.

Ending the license

This license lasts until you or we end it. You can end it at any time by removing Kaizen from your devices and no longer using the web app. Removing the app from a phone or computer deletes the data it stored there, such as your timer settings, downloaded music and backgrounds, a custom background, and your block list. Our Cookie Policy explains the few exceptions. For the web app, clear the site's data in your browser. None of this deletes your account or cancels a subscription. You can delete your account in the app.

We can end your license only for the reasons, and in the way, that our Terms describe, and unless the law stops us, we tell you why. When your license ends, stop using Kaizen and remove it from your devices.

Everything else is in our Terms

This license covers your right to use the Kaizen app. Our Terms and Conditions (my-kaizen.com/terms) cover everything else, including:

  • who can use Kaizen: you must be 13 or older, and if you are under 18 you need a parent's or guardian's permission
  • your account, and deleting it
  • Premium, free trials, payments, renewals, canceling, and refunds
  • what you share in Kaizen, and the rules for using Kaizen and Focus Rooms
  • suspending or closing accounts
  • our liability to you
  • changes to Kaizen
  • complaints and disputes

If this license and the Terms say different things about your license to use the app, this license applies. For everything else, the Terms apply. How we handle personal data is explained in our Privacy Policy (my-kaizen.com/privacy), which is not part of this license.

Changes to this license

We can update this license in the same way, and with the same notice, as our Terms. The date at the top of this page shows when it last changed.

Law and courts

Dutch law applies to this license. If you are a consumer, you also keep the protection of the mandatory consumer laws of the place where you live. You can take a dispute to the competent court in the Netherlands or, where your local law allows it, to the courts where you live, and if you are a consumer, we can only take you to court in the country where you live. We do not use arbitration.

If a court decides that part of this license is invalid, the rest still applies.
